Terms of Service — Juan Passport

This document is the agreement between you and HackLatino LLC for your use of the Juan Passport app and the juanpassport.com website. It is also the app's End User License Agreement (EULA). By creating an account or using the app, you accept these terms.

1. What Juan Passport is

Juan Passport lets you create digital keepsakes of the places and events you visit. You scan a QR code at the location, choose a template, and put together your keepsake with your photos and your words. Some experiences are published by a company, with its own branding inside the app.

2. Your account

You need to sign in with Google or Apple. You are responsible for your account's activity. The data you give us has to be true, in particular your date of birth.

3. Age

You must be at least 13 years old to use Juan Passport. The community videos section requires being 17 or older; you declare your age when you enter and we rely on that declaration.

4. Your content

The content you upload is yours. We do not claim ownership of it.

To be able to display it, you grant us a worldwide, non-exclusive, royalty-free, and revocable license to host it, store it, copy it, adapt it technically — for example, resizing it or converting its format —, process it with the AI features you turn on, and show it inside the app to whoever is entitled to see it based on the visibility you chose. This license exists solely to operate the service, and it ends when you delete the content or your account, with the exceptions described in the Privacy Policy.

We do not use your content to train our own models, we do not sell it, and we do not license it to third parties for advertising.

People in your photos. If you upload a photo where other people appear, or you write another person's name, you represent that you have their permission to do so. If minors appear, you must be their parent or guardian, or have their authorization.

5. What you cannot do

You cannot upload illegal, violent, sexually explicit, hateful, or harassing content; impersonate another person; upload third-party content without holding the rights to it; use the app for unsolicited advertising or for scams; try to access other people's accounts or data; scrape data in an automated way; or try to circumvent the service's technical limits.

We may remove content and suspend or close accounts that break these rules. When it is reasonable, we notify you beforehand.

6. Reports and moderation

You can report a keepsake or a video, and you can block another person. Content that accumulates several reports is automatically hidden from the public wall while we review it. Review is not instant.

7. AI-generated content

Stories are generated with third-party models. The result may have errors, artifacts, or differences from the original photo. We do not guarantee its accuracy or its fitness for any purpose, and you should not treat a Story as a faithful record of what happened. What is sent, and to whom, is covered in the Privacy Policy.

8. Company experiences

Some experiences are organized by a company, which defines its branding, its template, and its copy inside the app. That company is responsible for its own content, its brand, and the physical experience at the location. We operate the platform.

9. Our property

The app, the site, the Juan Passport name, its design, and its code belong to us or to those who license them to us. These terms do not give you any right to use our trademarks. The trademarks of the companies that publish experiences belong to those companies.

10. Availability and changes to the service

We work to keep the service available, but we do not guarantee that it will run without interruptions or without errors. We may add, change, or remove features. If we remove a feature that affects your content, we give reasonable advance notice when possible.

11. Termination

You can delete your account whenever you want, from Settings → Delete account. That ends this agreement. We may close your account if you breach these terms, or if we stop operating the service.

12. No warranties

The service is provided "as is" and "as available," without warranties of any kind, express or implied, including those of merchantability, fitness for a particular purpose, and non-infringement, to the extent the law allows.

13. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, or special damages, for lost profits, or for the loss of content. Keep your own copy of the photos that matter to you: the app is not a backup service.

14. Changes to these terms

If we change them, we update the date in the header and publish the new version here. If the change is material, we will ask you to accept it inside the app.

15. Appendix for apps installed from Apple's App Store

If you installed Juan Passport from the App Store, the following also applies:

• This agreement is between you and us, not with Apple. Apple is not a party to it.
• We, and not Apple, are solely responsible for the app and its content.
• Apple has no obligation whatsoever to provide any support or maintenance for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, to you. To the extent the law allows, Apple has no other warranty obligation whatsoever.
• We, and not Apple, are responsible for addressing any claims relating to product liability, failure to conform to any legal requirement, and consumer protection.
• We, and not Apple, are responsible for investigating and resolving any third-party claim that the app infringes their intellectual property rights.
• You represent that you are not located in a country subject to a U.S. government embargo, and that you are not on any list of restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of this appendix and may enforce it.
